Important: If you do not agree to these terms, please do not use our services. Continued use of any KB Connects service constitutes acceptance of these terms in full.
Section 02
Services Overview
KB Connects provides the following services to small and medium-sized businesses:
- AI-powered voice agents for inbound call handling
- Call automation and appointment booking
- CRM and workflow integrations (including GoHighLevel and Calendly)
- Business communication optimization tools
- SMS appointment reminders and follow-up automation
We reserve the right to modify, suspend, or discontinue any aspect of our services at any time, with or without notice. We are not liable to you or any third party for any such modification or discontinuation.

User Responsibilities
By using our services, you agree to the following obligations:
- Provide accurate, current, and truthful information about your business
- Use our services only for lawful business purposes
- Not misuse AI capabilities for spam calls, harassment, scams, or deceptive practices
- Comply with all applicable local, state, and federal laws — including telemarketing and consumer protection regulations (e.g., TCPA)
- Keep your account credentials secure and confidential
- Inform your customers of AI interactions where required by law
You are solely responsible for how your AI agent is configured, deployed, and used. KB Connects provides the technology; the business use case and compliance obligations remain with you.
Section 04
Payments & Billing
Our services may be billed monthly, per usage, or under a custom contract agreement, depending on the plan you select.
- All payments are non-refundable unless otherwise stated in your contract
- Failure to pay may result in service suspension or termination of your account
- Phase 1 (Free Trial) is offered at no charge for 30 days — no credit card required
- Phase 2 and Phase 3 pricing is agreed upon in writing before billing begins
- Revenue-share or performance-based arrangements must be documented in a separate written agreement
Custom pricing agreements (including percentage-of-revenue or phased pricing structures) are binding only when agreed upon in a signed written agreement between you and KB Connects.

AI Limitations Disclaimer
Our AI systems are powerful, but they are not infallible. By using our services, you acknowledge and accept the following:
- AI may produce incorrect, incomplete, or unexpected responses in some situations
- KB Connects is not liable for missed calls, incorrect bookings, or communication errors caused by AI behavior
- Human oversight is strongly recommended for critical or high-stakes operations
- AI performance may vary based on call quality, customer phrasing, and edge cases not covered in training
We continuously monitor and improve agent performance. If you notice consistent errors or unexpected behavior, contact our team — we will investigate and retrain your agent as needed.

Data Collection & Usage
To operate and improve our services, we may collect the following types of information:
- Business and contact information (name, phone number, email address)
- Call recordings and transcripts generated by your AI agent
- Appointment data and customer interaction records
- Usage analytics and platform performance data
This data is used to:
- Build, train, and improve your AI agent's performance
- Provide analytics and performance reporting to your account
- Operate, maintain, and secure our platform
- Communicate with you regarding your service
We do not sell your data to third parties. Data sharing is limited to what is strictly necessary to operate and improve your service. See the Privacy Policy section below for full details.

Call Recording & Consent
Our AI agents may record and transcribe calls for quality assurance, training, and analytics purposes. By activating and using our services, you agree that:
- Calls processed through your AI agent may be recorded and transcribed
- You are responsible for disclosing call recording to your customers where required by applicable law (e.g., two-party consent states)
- You will configure your agent to play appropriate disclosures if legally required in your jurisdiction
KB Connects is not responsible for your compliance with call recording laws. Requirements vary by state and country. Consult a legal professional regarding your specific disclosure obligations.

Third-Party Services
Our platform integrates with third-party services to deliver full functionality. These may include:
- Twilio (voice and SMS infrastructure)
- GoHighLevel (CRM and automation platform)
- Calendly, Google Calendar, and other booking integrations
KB Connects is not responsible for:
- Downtime, outages, or failures originating from third-party services
- The data handling, privacy practices, or terms of those platforms
- Any changes to third-party APIs or services that affect your agent's performance
We will make reasonable efforts to maintain integrations and notify you of material disruptions.

Data Security
We take the security of your data seriously and implement reasonable technical and organizational safeguards to protect it, including:
- Encrypted data transmission (TLS/HTTPS) for all communications
- Secure cloud infrastructure with access controls
- Restricted internal access to customer data on a need-to-know basis
No system is 100% secure. While we take all reasonable precautions, you use the service at your own risk. We cannot guarantee that unauthorized third parties will never be able to defeat our security measures.
In the event of a data breach that affects your account, we will notify you as required by applicable law and take immediate steps to investigate and remediate.

Termination
KB Connects reserves the right to suspend or terminate your account if:
- You violate any provision of these Terms of Service
- You fail to make required payments after the free trial period
- You misuse the platform, including illegal or abusive use of AI capabilities
- Continued service poses legal or reputational risk to KB Connects
You may cancel your services at any time. Cancellation terms vary based on your agreement — Phase 1 clients may cancel with no obligation. Phase 2 and Phase 3 clients are subject to the terms of their written contract.
Section 11
Limitation of Liability
To the fullest extent permitted by applicable law:
- KB Connects is not liable for any indirect, incidental, special, consequential, or punitive damages
- This includes but is not limited to: loss of revenue, missed leads, business interruptions, or reputational harm
- Our total liability to you for any claim arising from use of our services shall not exceed the amount you paid us in the three months preceding the claim
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above limitations may not apply to you in full.

Indemnification
You agree to defend, indemnify, and hold KB Connects (and its officers, directors, employees, contractors, and agents) harmless from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from:
- Your use or misuse of our services
- Your violation of these Terms of Service
- Your violation of any law, regulation, or third-party right in connection with the services
- Content or instructions you provide to configure your AI agent

SMS Terms & Conditions
By providing your phone number and opting in to SMS communications from KB Connects, you agree to receive text messages related to your account, free trial, service updates, and appointment information.
- Message frequency varies based on your service and account activity
- Message and data rates may apply based on your carrier plan
- To opt out at any time, reply STOP to any message
- To request help, reply HELP to any message
- SMS consent is optional and not required to use our services
Carriers are not liable for delayed or undelivered messages. SMS opt-in is never sold or transferred to third parties for marketing purposes.

Changes to Terms
We may update these Terms of Service and Privacy Policy at any time. When we make material changes, we will update the "Last Updated" date at the top of this page and, where appropriate, notify you via email.
Your continued use of our services after any such changes constitutes your acceptance of the updated terms. We encourage you to review this page periodically.

Call recordings and transcripts may be retained for up to 12 months for quality assurance and training purposes, after which they are purged from our systems.
